1. Introduction. Acceptance of these terms of use
Please read carefully the JAPP-Calisthenics Terms of Use, which include and incorporate the JAPP-Calisthenics Privacy Policy and the Terms of Use for the JAPP Calisthenics solution.
These Terms govern and apply to your access and use of the JAPP Calisthenics social media services available through the JAPP Calisthenics mobile applications and JAPP Calisthenics websites (https://japp-calisthenics.com).
BY ACCESSING, DOWNLOADING, USING, PURCHASING, PAYING FOR USE AND/OR SUBSCRIBING TO THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO THESE TERMS, WHICH MAY BE MODIFIED FROM TIME TO TIME. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MAY NOT USE THE SERVICES.
Please also note that if you subscribe to the Services, your subscription will automatically renew for certain periods of time unless you cancel it before the end of the term.
2. Eligibility
Anyone who wants to improve their physical condition has the opportunity to access JAPP-Calisthenics.
By creating an account and using the Service, you declare that you are acting with full knowledge and under your own responsibility and guarantee that you can enter into a binding contract with JAPP-Calisthenics.
3. Use of Services
You agree that you will only use the Services, including the posting of any content through the Services, in a manner consistent with these Terms and in compliance with all applicable local, provincial, federal, and international laws and regulations.
a) Record.
You must register and create only one unique account for the use of the services. To register a JAPP-Calisthenics Account, you can sign up using a valid email address, which will be verified, and provide certain information about yourself as requested in the registration form.
You understand and agree that anyone can see any information you choose to make public.
b) Security of the JAPP Calisthenics account.
You understand that you are fully responsible for maintaining the confidentiality of your Account, and that you are responsible for all activities conducted on your Account, including the purchase of any of our payment Services.
You are solely responsible for selecting an appropriate username and for any disclosure you make of your username to others, including any selection or disclosure that makes you personally identifiable.
You are responsible for maintaining the confidentiality of the username and password of your JAPP Calisthenics account and are fully responsible for all activities carried out with your JAPP Calisthenics account.
In case you forget your login details and wish to recover them, you will be directed to a password recovery section where you will be asked for the email address associated with your JAPP Calisthenics Account. You agree to immediately notify JAPP Calisthenics if you suspect that there has been unauthorized use of your JAPP Calisthenics Account or any other security breach, and to take special care when accessing your JAPP Calisthenics Account from a public or shared computer and/or mobile device, so that other people cannot see or record your personal information.
For example, never share your password and remember to log out of JAPP Calisthenics and lock your mobile device when not in use.

In this way, you acknowledge that JAPP Calisthenics is not, and will not be, responsible for any loss or damage resulting from the theft or misuse of your JAPP Calisthenics account. Furthermore, you acknowledge and agree that JAPP Calisthenics is not responsible for, nor has any control over, security breaches that occur on any third-party social media site.
c) Exclusive use.
You will only use the Services for your exclusive and personal use and not in connection with any commercial activity. You will not authorize others to use the Services, nor to access your JAPP Calisthenics account, nor will you attempt to transfer your right to use the Services to any other person or entity. If this occurs, JAPP Calisthenics reserves the right to disable, block, suspend, or deactivate the use or access of any User to the Services or to cancel the JAPP Calisthenics Account and/or the associated subscription of any User, for any reason and without prior notice, if they violate the rules set forth in this agreement.
d) Data usage charges.
The use of the Services on your mobile device may require the use of your data service. Depending on the plan you have with your mobile carrier, you may incur data charges. You should check with your mobile phone operator and determine how you will be charged for data usage. JAPP Calisthenics is not responsible for your data usage and will not be liable for any data charges you may incur while using the Services. You are responsible for any Internet connection, data, or other fees applied by your mobile carrier to access the Services through your wireless device, including data plan charges, toll, out-of-area, roaming, or other wireless device connection charges.
e) Interactions with other users.
JAPP Calisthenics is not responsible for the posts (photographs) that other users may publish.
Likewise, you assume all risks when using the Services, including, but not limited to, all risks associated with any information you publish. You acknowledge that JAPP Calisthenics does not routinely screen its users, nor investigate the backgrounds of its users, nor attempt to verify the information provided by its users, nor conduct criminal background checks on its users, so we kindly ask you to proceed with caution. JAPP Calisthenics does not offer any statement, guarantee, or assurance regarding the conduct of its Users or the information provided by them.
f) No to commercial advertising.
You will not engage in any type of advertising or solicitation for the purchase or sale of products or services through the use of the Services and will not transmit any chain letters, junk email, spam, or communications to other Users. Additionally, you will not use any information obtained from the Services to contact, advertise, solicit, or sell products or services to any User without their prior explicit consent.
In case of violating this rule, your account may be deleted without prior notice.
g) User behavior.
JAPP Calisthenics is not in any way responsible for the behavior of its Users, whether or not related to the use of the Services. You acknowledge that you use the Services at your own risk. To ensure the safe use of the Services, you agree not to do any of the following in relation to the Services or their Users:
* Use the Services in an illegal manner or in a way that is harmful or violates the rights of others;
* Engage in any illegal, lewd, harassing, obscene, intimidating, threatening, predatory, or stalking behavior;
* Using the Services in connection with hazardous environments that require fault-tolerant performance or with any application where the failure or inaccuracy of such application or the Services could directly cause death, personal injury, or serious physical or material damage, such as driving while using the Services
* Use the Services in any way that may interrupt, damage, disable, overload, harm, or affect the performance of the Services or the computer systems/technology of JAPP Calisthenics, or interfere with or attempt to interfere with the use of the Services or the computer systems/technology of any other User;
* Impersonate any person or entity, or falsify their age, identity, affiliation, connection, or association with any person or entity;
* Make any commercial use of the Services or promote or solicit participation or support for a political platform, religion, cult, or sect
* Defraud, scam, or deceive other Users;
* Disseminating another User’s information without their permission, or collecting or requesting another User’s personal information for commercial or illicit purposes;
* Request or participate in gambling or any similar activity or any illegal or illicit activity;
* Use any type of scripts, bots, or other automated technology to scrape or access the Services
* Use the Services for any phishing, trolling, or similar activities
* Use the Services to redirect Users to other sites or applications, or encourage them to visit other sites or applications
* Collect or gather email addresses or other contact information from other Users through the Services by electronic means or otherwise, or use the Services to send, directly or indirectly, any unsolicited mass email or communication, unsolicited commercial email or communication, or other spamming or junk mail activities;
* Distributing unsolicited commercial messages or spam, and/or using any robot, spider, site search/retrieval application, or other device or process, manual or automatic, to retrieve, index, “data mine,” or in any way reproduce or circumvent the navigation structure, security features, or presentation of the Services or their content;
* Attempting to access any Service that you are not authorized to access;
* Allow or permit other people or third parties to access and use the Services through your JAPP Calisthenics Account.
h) Reporting of violations.

i) Execution.
You understand and agree that if JAPP Calisthenics believes, in its sole discretion, that you have violated these Terms, misused the Services, or behaved in a manner that could be considered inappropriate, illegal, or unsafe, JAPP Calisthenics may, among other things, investigate, take legal action against you, and/or cancel your JAPP Calisthenics Account and your subscription and/or membership without prior notice.
4. User content
a) Definition; user content responsibility.
You are solely responsible for the content and information you provide, post, transmit, display, or otherwise communicate to JAPP Calisthenics through the Services, including, without limitation, profile images and information. JAPP Calisthenics does not control, is not responsible for, or assumes any responsibility for any User Content posted by you, other Users, or any third party, nor for any loss or damage that may occur, nor is it responsible for any error, defamation, slander, libel, omission, falsehood, obscenity, pornography, or blasphemy that you may encounter.
b) Accuracy of the information.
You will not post any inaccurate, misleading, incomplete, or false information or User Content to the Services or to any other User through the Services.
You agree that all images published on your JAPP Calisthenics Account are yours and are not subject to third-party copyright.
c) There is no obligation to review user content.
Although you understand and acknowledge that JAPP Calisthenics is not obligated to pre-screen, review, monitor, supervise, or edit User Content posted by users and is not responsible for User Content provided by others, you agree that JAPP Calisthenics may, at its sole discretion, review, edit, refuse to accept, or remove User Content at any time and for any reason or without any reason, without prior notice.
You are solely responsible for creating backups and replacing any User Content that you post or store on the Services, at your sole cost and expense. This includes the right of JAPP Calisthenics to modify, crop, or delete any photo you post to comply with JAPP Calisthenics’ policies, practices, and procedures.
5. User Content License to JAPP Calisthenics
JAPP Calisthenics does not claim ownership or control of your User Content, unless otherwise stipulated in this document, in the Services, or in a separate agreement. By submitting or posting User Content, you automatically grant, and represent and warrant that you have the right to grant, to JAPP Calisthenics, its affiliates, licensees, and successors, an irrevocable, perpetual, non-exclusive, fully paid, and worldwide right and license to use, copy, publicly perform, publicly display, reproduce, adapt, modify, and distribute such User Content provided by you and to prepare derivative works of, or incorporate into other works, such information and User Content, and to grant and authorize sublicenses of the foregoing in any medium.
You declare and guarantee that the User Content and the publication and use of your User Content by JAPP Calisthenics will not infringe or violate any third-party rights, including, without limitation, intellectual property rights or privacy or publicity rights, nor will it cause any harm to third parties or violate these Terms.
Furthermore, you declare and guarantee that you have obtained written consent from each and every identifiable individual appearing in your User Content (including, but not limited to, any content you submit to JAPP Calisthenics for presentation) to use the name or image of such individuals in the manner contemplated in the Services and in these Terms, and that each of such individuals has released you from any liability that may arise in connection with such use.
By posting User Content, you release JAPP Calisthenics, its directors, officers, shareholders, employees, contractors, and agents from any claim that such use, as previously authorized, violates any of your rights, and you understand that you will not be entitled to any additional compensation for any use that JAPP Calisthenics makes of your User Content. You also grant JAPP Calisthenics the right to select JAPP Calisthenics Accounts to appear in the Services to enhance their visibility at no additional cost, at the sole discretion of JAPP Calisthenics.
6. Use of information belonging to others
You will not publish, copy, transfer, create derivative works, distribute, reproduce or display in any way any information or material protected by copyright or trademark, including any User Content posted by other Users, without the prior consent of the owner of such property rights. You acknowledge that the information or materials available through the Services may be protected by copyright, whether or not identified as such.
7. Communications
We may send you notifications in any of the following ways. First, we may send you an email to the email address you provided when you created your JAPP Calisthenics Account. Second, we may post the notice on the Services. When we post notices on the Services, we do so in the area of the Services appropriate to the notice. It is your responsibility to periodically review the Services for notices.
JAPP Calisthenics also reserves the right, in its sole discretion, to refuse to post any User Submission it receives from you.
8. Objectionable or prohibited content
JAPP Calisthenics does not tolerate objectionable or prohibited content. It is not permitted to publish, transmit, or deliver to any other User, either directly or indirectly, any User Content that infringes the rights of third parties or any applicable law, regulation, or international standard, or that is prohibited under these Terms or any other JAPP Calisthenics policy governing your use of the Services (“Objectionable or Prohibited Content”). Objectionable or prohibited Content includes, without limitation, User Content that
* Be defamatory, abusive, offensive, threatening, harassing, incendiary, inaccurate, misleading, fraudulent, or illegal;
* Promote racism, sexism, homophobia, fanaticism, hatred, or physical harm of any kind against any group or individual
* Intend to harass or intimidate any other user or third party, or do so;
* May infringe or violate any patent, trademark, trade secret, copyright, or other intellectual or proprietary rights of any party, including User Content that contains copyright-protected content of others (e.g., photos, images, music, movies, videos, etc.) without first obtaining the appropriate permission.
* Contains video, audio, photographs, or images of another person without their express consent (or, in the case of a minor, the consent of their legal guardian) or otherwise violates the right to privacy or publicity of any person
* Promote or allow illegal or illicit activities, such as instructions on how to manufacture or purchase weapons or illegal drugs
* Violates someone’s privacy or data protection rights;
* Contains viruses, time bombs, malicious programs, trojans, cancelbots, worms, or other harmful or disruptive codes, components, or devices
* Contains advertising, fundraising, or promotional content;
* Be, at the sole discretion of JAPP Calisthenics, objectionable or restrict or impede any person from using or enjoying the Services or expose JAPP Calisthenics or its Users to damages or liabilities of any kind.
9. Privacy
JAPP Calisthenics takes the protection of your personal information very seriously.
Please consult our Privacy Policy for information on how JAPP Calisthenics collects, uses, stores, and discloses its Users’ personal information.
You understand and agree that if you post any User Content, information, or material of a personal or private nature on your profile or in any private or public area of the Services, or post or provide JAPP Calisthenics with any information or content that is intended to be shared with other Users, such content, information, and materials will be shared with others accordingly, and you hereby consent to their sharing.
You understand that by using the Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
