1. Introduction. Acceptance of these Terms of Use

Please read these JAPP Calisthenics Terms of Use carefully. These Terms include and incorporate the Privacy Policy and the Terms of Use of the JAPP Calisthenics solution.

These Terms govern and apply to your access to and use of JAPP Calisthenics services available through JAPP Calisthenics mobile applications and the JAPP Calisthenics websites (https://japp-calisthenics.com).

BY ACCESSING, DOWNLOADING, USING, PURCHASING, PAYING FOR, AND/OR SUBSCRIBING TO THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS, WHICH MAY BE MODIFIED FROM TIME TO TIME. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MAY NOT USE THE SERVICES.

Please also note that if you subscribe to the Services, your subscription will renew automatically for successive periods unless you cancel before the end of the current term.

2. Eligibility

Anyone who wants to improve their physical fitness has the opportunity to access JAPP Calisthenics.

By creating an account and using the Service, you represent that you act knowingly and under your own responsibility, and you warrant that you can enter into a binding contract with JAPP Calisthenics.

3. Use of the Services

You agree to use the Services, including posting any content through the Services, only in a manner consistent with these Terms and in compliance with all applicable local, provincial, federal, and international laws and regulations.

a) Registration

You must register and create a single unique account to use the Services. To register a JAPP Calisthenics Account, you may sign up using a valid email address (which will be verified) and provide certain information about yourself as requested in the registration form.

You understand and agree that anyone may view any information you choose to make public.

b) JAPP Calisthenics account security

You understand that you are fully responsible for maintaining the confidentiality of your Account and for all activities that occur under your Account, including the purchase of any of our paid Services.

You are solely responsible for selecting an appropriate username and for any disclosure you make of your username to others, including any selection or disclosure that makes you personally identifiable.

You are responsible for maintaining the confidentiality of your username and password and are fully responsible for all activities carried out using your JAPP Calisthenics account.

If you forget your login details and wish to recover them, you will be directed to a password recovery section where you will be asked for the email address associated with your JAPP Calisthenics Account. You agree to immediately notify JAPP Calisthenics if you suspect any unauthorized use of your JAPP Calisthenics Account or any other security breach, and to take special care when accessing your account from a public or shared computer and/or mobile device so that others cannot view or record your personal information.

For example, never share your password, remember to log out, and lock your mobile device when you are not using it.

Email us at info@japp-calisthenics.com if you believe an unauthorized person has accessed your JAPP Calisthenics account.

You acknowledge that JAPP Calisthenics is not, and will not be, responsible for any loss or damage arising from theft or misuse of your JAPP Calisthenics account. Additionally, you acknowledge and agree that JAPP Calisthenics is not responsible for and has no control over security breaches that occur on any third-party social networking site.

c) Personal use only

You will use the Services solely for your personal, non-commercial use. You will not authorize others to use the Services or access your JAPP Calisthenics account, nor will you attempt to transfer your right to use the Services to any other person or entity. If this occurs, JAPP Calisthenics reserves the right to disable, block, suspend, or deactivate any user’s access to the Services, or cancel any JAPP Calisthenics account and/or associated subscription, for any reason and without prior notice, if the user violates the rules set out in this agreement.

d) Data usage charges

Using the Services on your mobile device may require the use of your data service. Depending on your mobile carrier plan, you may incur data charges. You should check with your mobile carrier to determine how you will be charged for data use. JAPP Calisthenics is not responsible for your data usage and will not be responsible for any data charges you may incur while using the Services. You are responsible for any Internet connection, data, or other fees charged by your mobile carrier to access the Services via your wireless device, including data plan charges, tolls, out-of-area, roaming, or other wireless connection charges.

e) Interactions with other users

JAPP Calisthenics is not responsible for posts (photographs) that other users may publish.

You assume all risks when using the Services, including, without limitation, all risks associated with any information you post. You acknowledge that JAPP Calisthenics does not routinely screen users, investigate users’ backgrounds, attempt to verify information provided by users, or conduct criminal background checks, so please proceed with caution. JAPP Calisthenics makes no representations, warranties, or guarantees regarding users’ conduct or the information they provide.

f) No commercial advertising

You will not advertise or solicit the purchase or sale of products or services through the Services, and you will not transmit chain letters, junk email, spam, or communications to other users. In addition, you will not use any information obtained from the Services to contact, advertise to, solicit, or sell products or services to any user without their prior explicit consent.

If you violate this rule, your account may be deleted without prior notice.

g) User conduct

JAPP Calisthenics is not responsible in any way for the conduct of its users, whether or not related to the use of the Services. You acknowledge that you use the Services at your own risk. To keep the Services safe, you agree that you will not do any of the following in connection with the Services or other users:

  • Use the Services unlawfully or in a way that is harmful or violates the rights of others;
  • Engage in any illegal, lewd, harassing, obscene, intimidating, threatening, predatory, or abusive behavior;
  • Use the Services in connection with dangerous environments requiring fail-safe performance or any application where a failure or inaccuracy of the application or Services could directly cause death, personal injury, or severe physical or property damage (e.g., driving while using the Services);
  • Use the Services in any way that could disrupt, damage, disable, overburden, impair, or affect the performance of the Services or JAPP Calisthenics systems or interfere or attempt to interfere with any other user’s use of the Services;
  • Impersonate any person or entity, or misrepresent your age, identity, affiliation, or association with any person or entity;
  • Make any commercial use of the Services or promote or solicit participation in or support for a political platform, religion, cult, or sect;
  • Defraud, scam, or deceive other users;
  • Disclose another user’s information without permission, or collect or solicit personal information from another user for commercial or unlawful purposes;
  • Request or participate in gambling or any similar activity, or any illegal or unlawful activity;
  • Use scripts, bots, or other automated technology to scrape or access the Services;
  • Use the Services for phishing, trolling, or similar activity;
  • Use the Services to redirect users to other websites or applications, or encourage them to visit other websites or applications;
  • Collect email addresses or other contact information of other users from the Services by electronic or other means, or use the Services to send, directly or indirectly, unsolicited mass email or communications, unsolicited commercial email or communications, or other spam/junk mail activities;
  • Distribute unsolicited commercial messages or spam, or use any robot, spider, site-search/retrieval application, or other manual or automatic device or process to retrieve, index, data mine, reproduce, or otherwise bypass the navigation structure, security features, or presentation of the Services or its content;
  • Attempt to access any Service you are not authorized to access;
  • Allow third parties to access and use the Services through your JAPP Calisthenics Account.
h) Reporting violations

If you wish to report any violation of these Terms by others, including users, you may do so by emailing info@japp-calisthenics.com.

i) Enforcement

You understand and agree that if JAPP Calisthenics believes, in its sole discretion, that you have violated these Terms, misused the Services, or behaved in a manner that could be considered inappropriate, unlawful, or unsafe, JAPP Calisthenics may, among other things, investigate, take legal action against you, and/or cancel your JAPP Calisthenics Account and your subscription and/or membership without prior notice.

4. User content

a) Definition; responsibility for user content

You are solely responsible for the content and information that you provide, post, transmit, display, or otherwise communicate to JAPP Calisthenics through the Services, including, without limitation, images and profile information. JAPP Calisthenics does not control, endorse, or assume responsibility for any user content posted by you, other users, or any third party, nor for any loss or damage that occurs, and is not responsible for any error, defamation, slander, insult, omission, falsehood, obscenity, pornography, or profanity you may encounter.

b) Accuracy of information

You will not post any inaccurate, misleading, incomplete, or false information or user content to the Services or to any other user through the Services.

You agree that all images posted on your JAPP Calisthenics Account are yours and are not subject to third-party copyrights.

c) No obligation to review user content

While you understand and acknowledge that JAPP Calisthenics has no obligation to pre-screen, review, monitor, supervise, or edit user content posted by users and is not responsible for user content provided by others, you agree that JAPP Calisthenics may, at its sole discretion, review, edit, refuse to accept, or remove user content at any time for any reason or no reason, without notice.

You are solely responsible for creating backups and replacing any user content you post or store in the Services, at your sole cost and expense. This includes JAPP Calisthenics’ right to modify, crop, or delete any photo you post to comply with JAPP Calisthenics policies, practices, and procedures.

5. License of user content to JAPP Calisthenics

JAPP Calisthenics does not claim ownership or control over your user content unless otherwise stated in this document, in the Services, or in a separate agreement. By submitting or posting user content, you automatically grant, and represent and warrant that you have the right to grant, to JAPP Calisthenics, its affiliates, licensees, and successors, an irrevocable, perpetual, non-exclusive, fully paid, worldwide right and license to use, copy, publicly perform, publicly display, reproduce, adapt, modify, and distribute such user content provided by you, to prepare derivative works from (or incorporate into other works) such information and user content, and to grant and authorize sublicenses of the foregoing in any media.

You represent and warrant that your user content, and the posting and use of your user content by JAPP Calisthenics, will not infringe or violate any third-party rights, including, without limitation, intellectual property rights or privacy/publicity rights, will not cause harm to any third party, and will not violate these Terms.

In addition, you represent and warrant that you have written consent from each and every identifiable natural person appearing in your user content (including, without limitation, any content you submit to JAPP Calisthenics for featuring) to use the name or image of such persons as contemplated by the Services and these Terms, and that each such person has released you from any liability that may arise in connection with such use.

By posting user content, you release JAPP Calisthenics, its directors, officers, shareholders, employees, contractors, and agents from any claim that such use, as authorized above, violates any of your rights, and you understand that you will not be entitled to any additional compensation for any use of your user content by JAPP Calisthenics. You also grant JAPP Calisthenics the right, at its sole discretion, to select JAPP Calisthenics Accounts to appear in the Services to improve visibility at no additional cost.

6. Use of proprietary information owned by others

You will not post, copy, transfer, create derivative works, distribute, reproduce, or display in any way any information or material protected by copyright or trademark, including any user content posted by other users, without the prior consent of the owner of such proprietary rights. You acknowledge that information or materials available through the Services may be protected by copyright, whether or not identified as such.

7. Communications

We may send you notices in any of the following ways: first, we may send an email to the email address you provided when you created your JAPP Calisthenics Account. Second, we may present the notice within the Services. When we post notices in the Services, we do so in the area of the Services appropriate to the notice. It is your responsibility to review the Services periodically to check for notices.

JAPP Calisthenics also reserves the right, in its sole discretion, to refuse to post any user submission it receives from you.

8. Objectionable or prohibited content

JAPP Calisthenics does not tolerate objectionable or prohibited content. You may not post, transmit, or deliver to any other user, directly or indirectly, any user content that infringes third-party rights or any applicable international law, rule, or regulation, or that is prohibited under these Terms or any other JAPP Calisthenics policy governing your use of the Services (“Objectionable or Prohibited Content”). Objectionable or Prohibited Content includes, without limitation, user content that:

  • Is defamatory, abusive, offensive, threatening, harassing, inflammatory, inaccurate, misleading, fraudulent, or illegal;
  • Promotes racism, sexism, homophobia, bigotry, hatred, or physical harm of any kind against any group or individual;
  • Intends to harass or intimidate any other user or third party, or does so;
  • May infringe or violate any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party, including user content that contains copyrighted content of others (e.g., photos, images, music, movies, videos, etc.) without first obtaining the appropriate permission;
  • Contains video, audio, photographs, or images of another person without their express consent (or, in the case of a minor, the consent of their legal guardian), or otherwise violates any person’s right to privacy or publicity;
  • Promotes or enables illegal activities, such as instructions on how to make or buy illegal weapons or drugs;
  • Violates someone’s privacy or data protection rights;
  • Contains viruses, time bombs, malware, trojans, cancelbots, worms, or other harmful or disruptive code, components, or devices;
  • Contains advertising, fundraising, or promotional content;
  • Is, in JAPP Calisthenics’ sole judgment, objectionable or restricts or inhibits any person’s use or enjoyment of the Services or exposes JAPP Calisthenics or its users to harm or liability of any kind.

9. Privacy

JAPP Calisthenics takes the protection of your personal information very seriously.

Please see our Privacy Policy to learn how JAPP Calisthenics collects, uses, stores, and discloses users’ personal information.

You understand and agree that if you post any user content, information, or material of a personal or private nature in your profile or in any private or public area of the Services, or if you post or provide to JAPP Calisthenics any information or content that is intended to be shared with other users, such content, information, and materials will be shared accordingly, and you hereby consent to such sharing.

You understand that by using the Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
